This was required to be divulged during discovery, and wasn't. KE appealed to the judge to have this new information taken into consideration, and the judge has just ruled that it may be. It will be appended to the motions to dismiss various elements (potentially all) of the suit, and hopefully we will having those motions ruled on next month.
